Legal
Terms
The terms on which Sidekick Radio is offered to an organisation that connects a phone system to it. They are short because the service does one thing.
This is a template, not legal advice.
What the service is
Sidekick Radio relays live radio stations to telephone calls. Your phone system connects to ours by SIP trunk and dials a station’s code; the caller is put in that station’s queue and hears it as it is broadcast. [Operator’s legal name] (“we”) operates this installation.
The public site, its directory and its players are free to use. Connecting a phone system is by agreement with us.
Connecting a phone system
There is no public sign-up. We set up each trunk with the organisation that asks for it, and may decline to. [Any charges, and how they are invoiced, are set out in a separate order.]
You are responsible for your own phone system, for the people who use it, and for keeping any user name and password we issue to you secret. Tell us at once if you think they have been exposed; we will replace them.
Using it fairly
Use the service for people to listen to radio. Do not use it to probe or overload the platform or the stations’ own servers, to place calls with no listener in bulk, or to offer the service to third parties as your own without our agreement.
We may limit how many calls a trunk can hold at once, how many callers a station’s queue will take, and how long one call may last, and we may end a call or suspend a trunk that is harming the service.
Broadcast rights are yours to clear
The stations belong to their broadcasters. The platform relays them unaltered and gives you no rights in them. Relaying a broadcast to telephone callers, and still more keeping a recording of it, can need the permission of the station or of a collecting society, depending on where you and your callers are. Obtaining whatever permission your use needs is your responsibility, not ours.
We may switch off any station, country or queue at any time, and will do so at a rights holder’s reasonable request.
The catalogue is not ours
The list of stations comes from the Radio Browser community directory and is brought up to date daily. We do not promise that any station is listed, is on air, or is what its listing says. A dial code, once given to a station, is not changed or given to another; the station behind it may still stop broadcasting.
Availability
We run the service with reasonable care and [without a guaranteed level of availability unless one is agreed in writing]. It may be interrupted for maintenance, and a station may be unavailable for reasons outside our control. Do not rely on it for anything where an interruption would cause harm.
Call records and recording
We keep a record of each call, as the privacy notice describes. We record what callers hear only where recording has been switched on for a station’s queue, and never what a caller says.
Liability
[The operator’s limitation of liability, as permitted by the law that applies, goes here.] Nothing in these terms limits liability that cannot lawfully be limited.
Ending the arrangement
You can stop using the service at any time by removing the trunk from your phone system and telling us. We can end it on [notice period], or at once if these terms are broken. On ending, we remove your trunk and its credentials; call records are kept and deleted as the privacy notice describes.
Law
These terms are governed by the law of [jurisdiction], and its courts have jurisdiction over any dispute about them.
